Overview
Brown v. Board of Education of Topeka, 347 U.S. 483 (1954), is a landmark Supreme Court decision that declared racial segregation in public schools unconstitutional. The unanimous ruling overturned the separate but equal doctrine established in Plessy v. Ferguson (1896) and catalyzed the civil rights movement. Brown is widely regarded as the most important Supreme Court decision of the twentieth century.
The case was the culmination of decades of legal strategy by the National Association for the Advancement of Colored People (NAACP), led by future Supreme Court Justice Thurgood Marshall. The NAACP’s litigation campaign challenged segregation in graduate and professional education before targeting elementary and secondary schools. Brown represented the decisive breakthrough in this long legal struggle.
Facts of the Case
The case consolidated four class actions from Kansas, South Carolina, Virginia, and Delaware, each challenging racial segregation in public schools. African American children had been denied admission to all-white schools under laws requiring or permitting racial segregation. The plaintiffs argued that segregated schools violated the Equal Protection Clause of the Fourteenth Amendment.
In Kansas, Oliver Brown sued on behalf of his daughter Linda, who was required to attend a segregated school far from their home despite a closer white school. In South Carolina, plaintiffs challenged a system where Black schools were grossly underfunded compared to white schools. In Virginia, plaintiffs challenged a system of massive resistance to desegregation. In Delaware, the state court had already ordered desegregation based on the inequality of facilities.
A three-judge district court in Kansas found that segregation had detrimental effects on African American children but upheld the separate but equal doctrine under Plessy, finding that the physical facilities and other tangible factors in the schools were substantially equal. The plaintiffs appealed directly to the Supreme Court.
Legal Question
The central question was whether segregation of children in public schools solely on the basis of race, even when physical facilities and other tangible factors were equal, deprived African American children of equal educational opportunities in violation of the Fourteenth Amendment. The case directly challenged the Plessy framework, which had upheld segregation in transportation as constitutionally permissible.
The Court had already signaled a willingness to reconsider Plessy in graduate education cases. In Sweatt v. Painter (1950), the Court held that a separate Texas law school for Black students was not equal because of intangible factors such as faculty reputation, alumni network, and intellectual atmosphere. In McLaurin v. Oklahoma State Regents (1950), the Court held that a Black graduate student admitted to a white university could not be segregated within the university. These cases laid the groundwork for challenging segregation directly.
The Decision
Chief Justice Earl Warren delivered the unanimous opinion, holding that separate educational facilities are inherently unequal. The Court rejected the Plessy framework for the context of public education, concluding that the intangible effects of segregation — the sense of inferiority generated in African American children — deprived them of equal educational opportunity regardless of the equality of physical facilities.
The Court’s reasoning emphasized the importance of education in modern society. Education is “the very foundation of good citizenship” and is required for the performance of basic public responsibilities. When a state provides education, it must be provided equally to all. Segregation based solely on race generates “a feeling of inferiority as to their status in the community that may affect their hearts and minds in a way unlikely ever to be undone.”
The Court relied heavily on social science evidence, particularly Kenneth Clark’s doll studies and other research demonstrating that segregation damaged African American children’s self-esteem and development. The celebrated Footnote 11 cited psychological and sociological studies showing that segregation had detrimental effects on both Black and white children. This reliance on social science was controversial but demonstrated the Court’s determination to base its decision on evidence about real-world effects.
The Court deliberately avoided deciding the remedy in the initial decision. Instead, the Court ordered reargument on the question of remedy, leading to Brown II (349 U.S. 294, 1955), which ordered desegregation to proceed with all deliberate speed — a formulation that allowed lower courts flexibility but also permitted significant delay in implementation.
Significance and Impact
Brown was the catalyst for the modern civil rights movement. The decision directly invalidated de jure segregation in education and provided the constitutional foundation for subsequent challenges to segregation in other contexts. The decision inspired a generation of civil rights activists and gave moral and legal authority to the struggle against racial discrimination.
The decision faced massive resistance, particularly in Southern states. Many states passed interposition resolutions declaring Brown null and void within their borders. Some school districts closed public schools entirely rather than desegregate. President Eisenhower was forced to send federal troops to Little Rock, Arkansas, in 1957 to enforce desegregation of Central High School. Southern members of Congress issued the Southern Manifesto, pledging to resist desegregation by all lawful means.
Despite resistance, Brown transformed American society. By the late 1960s and 1970s, extensive desegregation had occurred in Southern schools, and the decision provided the legal foundation for the Civil Rights Act of 1964 and the Voting Rights Act of 1965. The decision also established the principle that racial classifications must serve compelling government interests and be narrowly tailored.

Brown’s legacy extends beyond education. The case established the principle that racial segregation is constitutionally suspect and that the Equal Protection Clause prohibits government action that stigmatizes racial minorities. The case inspired subsequent civil rights litigation, including challenges to housing discrimination, employment discrimination, and voting discrimination.
