Clean Air Act

Introduction

The Clean Air Act (CAA) , originally enacted in 1970 and substantially amended in 1977 and 1990, is the primary federal statute governing air quality in the United States. The CAA establishes a comprehensive regulatory framework for controlling air pollution from stationary sources (factories, power plants) and mobile sources (vehicles, aircraft). The statute is administered by the Environmental Protection Agency (EPA) in cooperation with state and local governments.

National Ambient Air Quality Standards

Section 109 of the CAA requires the EPA to establish National Ambient Air Quality Standards (NAAQS) for pollutants that endanger public health and welfare. The EPA has established NAAQS for six criteria pollutants: ozone, particulate matter, carbon monoxide, nitrogen dioxide, sulfur dioxide, and lead. Primary NAAQS protect public health, and secondary NAAQS protect public welfare.

The EPA must review and revise the NAAQS every five years based on the latest scientific evidence. In Massachusetts v. EPA (2007), the Supreme Court held that the CAA authorizes the EPA to regulate greenhouse gases as air pollutants. The Court held that greenhouse gases fall within the CAA’s definition of “air pollutant” and that the EPA must regulate them if they endanger public health or welfare.

State Implementation Plans

Under Section 110, each state must develop a State Implementation Plan (SIP) that demonstrates how the state will achieve and maintain the NAAQS. SIPs must include emission limitations, monitoring requirements, enforcement mechanisms, and provisions for interstate transport of pollution. The EPA must approve SIPs that meet the CAA’s requirements.

If a state fails to submit an adequate SIP, the EPA must promulgate a Federal Implementation Plan (FIP) for the state. Areas that do not meet the NAAQS are designated as nonattainment areas and are subject to more stringent requirements, including stricter emission controls and offset requirements for new sources.

Prevention of Significant Deterioration

The Prevention of Significant Deterioration (PSD) program applies to new major sources and major modifications in areas that meet the NAAQS (attainment areas). The PSD program requires Best Available Control Technology (BACT) , air quality modeling, and public participation. The program is designed to prevent clean areas from deteriorating to nonattainment status.

The New Source Review (NSR) program applies to new sources in nonattainment areas, requiring Lowest Achievable Emission Rate (LAER) and emission offsets. The distinction between PSD and NSR reflects the different regulatory approaches for attainment and nonattainment areas.

Mobile Sources

Title II of the CAA regulates emissions from mobile sources, including cars, trucks, buses, aircraft, and marine vessels. The EPA sets emission standards for new motor vehicles and engines, and the standards become increasingly stringent over time. California has a waiver under Section 209 to adopt its own mobile source standards, and other states may adopt California’s standards under Section 177.

The CAA also requires the use of oxygenated fuels, reformulated gasoline, and other fuel controls to reduce vehicle emissions. The renewable fuel standard (RFS) program requires the use of renewable fuels in transportation.

The Acid Rain Program

Title IV of the CAA Amendments of 1990 established the Acid Rain Program, the first large-scale cap-and-trade program in the United States. The program set a national cap on sulfur dioxide emissions from power plants and allocated emission allowances that could be bought and sold. The program successfully reduced acid rain at lower cost than traditional regulation.

Massachusetts v. EPA

In Massachusetts v. EPA (2007), the Supreme Court held that the EPA has authority under the CAA to regulate greenhouse gases. The Court found that Massachusetts had standing because its coastline was threatened by sea-level rise caused by climate change. The EPA subsequently made an endangerment finding for greenhouse gases and began regulating emissions from motor vehicles under Title II.
