French Nuclear Energy Regulation: Safety, Liability, and Energy Transition

French nuclear energy law governs the development, operation, and regulation of nuclear power generation in France, which has one of the highest shares of nuclear electricity in the world. The legal framework encompasses nuclear safety, nuclear liability, the decommissioning of nuclear facilities, and the management of radioactive waste. The field is regulated by the Code de l’environnement, the Code de l’énergie, and specialised legislation, with oversight by the Autorité de Sûreté Nucléaire (ASN).

The Code de l’Énergie

The Code de l’énergie (Energy Code) codifies French legislation on energy, including nuclear energy. The Code establishes the legal framework for energy policy, including the objectives for nuclear power generation, the regulation of nuclear facilities, and the obligations of nuclear operators. The Code was created by Ordinance No. 2011-504 of 9 May 2011 and has been regularly updated.

The Energy Code sets out the objectives for the energy mix, including the share of electricity generated from nuclear power. The Loi de transition énergétique pour la croissance verte (Law on Energy Transition for Green Growth) of 2015 set a target of reducing the share of nuclear power to 50% of electricity generation by 2025, a target that has since been postponed. The energy transition objectives continue to be debated, with nuclear power remaining a significant part of the French energy mix.

ASN Safety Authority

The Autorité de Sûreté Nucléaire (ASN) is the independent administrative authority responsible for nuclear safety and radiation protection. Established by the Law of 13 June 2006 on transparency and security in nuclear matters, the ASN oversees the safety of nuclear facilities, the transport of radioactive materials, and the management of radioactive waste.

The ASN has extensive regulatory powers. It issues regulations on nuclear safety, conducts inspections of nuclear facilities, and may impose sanctions for non-compliance. The ASN also authorises the creation and operation of nuclear facilities, the transport of radioactive materials, and the discharge of radioactive effluents.

The ASN is composed of a college of five commissioners appointed for six-year terms. The ASN’s decisions are subject to appeal before the Conseil d’État. The ASN publishes annual reports on the state of nuclear safety in France and contributes to the development of international nuclear safety standards.

Nuclear Liability

Nuclear liability is governed by the Convention on Third Party Liability in the Field of Nuclear Energy (the Paris Convention of 1960, as amended) and the Code de l’environnement (Articles L. 597-1 to L. 597-28). The regime establishes the principle of strict liability of the nuclear operator, the channelling of liability to the operator, and the limitation of liability in amount and time.

The operator of a nuclear installation is strictly liable for damage caused by a nuclear incident. The operator’s liability is limited in amount: the operator is liable up to €700 million for damage caused by an incident at a nuclear installation, with additional compensation provided by the state and by international mechanisms. The liability is also limited in time: claims must be brought within ten years of the incident.

EDF Monopoly History

The French nuclear industry has historically been dominated by Électricité de France (EDF), the state-owned electricity company. EDF was created by the Law of 8 April 1946, which nationalised the electricity and gas industries. EDF held a monopoly over electricity generation, transmission, and distribution until the liberalisation of the European electricity market.

The EU directives on the internal electricity market (1996, 2003, 2009) progressively opened the French electricity market to competition. EDF’s monopoly was dismantled: the generation market was opened to competition, the transmission network was separated from EDF and managed by Réseau de Transport d’Électricité (RTE), and the distribution network was opened to alternative suppliers. EDF remains the dominant operator of nuclear power plants, but other companies may invest in new nuclear capacity.

Loi de Transition Énergétique

The Loi de transition énergétique pour la croissance verte (Law on Energy Transition for Green Growth) of 17 August 2015 established the legal framework for the transition of the French energy system. The law set ambitious targets: reducing the share of nuclear power to 50% of electricity generation by 2025, reducing greenhouse gas emissions by 40% by 2030 (compared to 1990), and increasing the share of renewable energy to 32% of final energy consumption by 2030.

The target for nuclear power has been controversial. The 50% target for 2025 was postponed to 2035 by the Loi Énergie-Climat of 2019. The debate about the role of nuclear power in the energy transition continues, with some advocating for a rapid phase-out of nuclear power and others arguing that nuclear power is essential for meeting climate objectives.

Nuclear Phase-Down Debate

The debate about the future of nuclear power in France has intensified in recent years. The Loi Énergie-Climat of 2019 set a target of closing 12 nuclear reactors by 2035, but the timetable has been debated. President Emmanuel Macron announced in 2022 that France would build six new EPR2 reactors and study the construction of an additional eight, marking a significant shift in nuclear policy.

The nuclear phase-down debate involves complex legal, economic, and environmental questions. The decommissioning of existing nuclear facilities requires significant investment and raises questions about waste management and worker protection. The construction of new nuclear capacity requires regulatory approvals, financing arrangements, and public acceptance.

Radioactive Waste Management

The management of radioactive waste is governed by the Code de l’environnement and the Code de la santé publique. The Agence Nationale pour la Gestion des Déchets Radioactifs (ANDRA) is responsible for the management of radioactive waste. The agency operates surface repositories for low- and intermediate-level waste and is developing a deep geological repository for high-level waste.

The Loi de programme relative à la gestion durable des matières et déchets radioactifs of 28 June 2006 established the framework for the long-term management of radioactive waste. The law requires ANDRA to research and develop disposal solutions and to report regularly to Parliament. The Projet Cigéo (Centre Industriel de Stockage Géologique) is the project for a deep geological repository for high-level and intermediate-level long-lived waste.

Nuclear Security

Nuclear security is regulated by the Code de la défense and the Code de l’environnement. The Haut Fonctionnaire de Défense et de Sécurité (HFDS) is responsible for nuclear security policy. Nuclear operators must implement security measures to protect nuclear facilities and materials from malicious acts.

The French nuclear security regime includes requirements for physical protection, cybersecurity, and personnel reliability. The ASN and the Service Central de Sécurité des Installations Nucléaires (SCSSIN) oversee compliance with nuclear security requirements.
