Regulation (EU) 2023/2854 on harmonised rules on fair access to and use of data (Data Act)

Overview

The Data Act harmonizes rules on fair access to and use of data generated by connected products and related services. It gives users of connected devices (IoT) the right to access and share data generated by their use, establishes rules for business-to-business and business-to-government data sharing, prohibits unfair contractual terms in data access agreements, facilitates switching between cloud providers, and introduces interoperability requirements. Regulation (EU) 2023/2854 applies from 12 September 2025, with cloud switching provisions applying from 12 September 2027.
